These rules set forth procedures for circuit court and family court minor guardianship proceedings instituted pursuant to W. Va. Code § 44-10-1, et seq. If these rules conflict with other rules or statutes, these rules shall apply. Provided, these rules have no application to proceedings involving settlement of a minor’s claims for damages for injury to person or property. The procedures for such proceedings are governed by the Minor Settlement Proceedings Reform Act codified at W. Va. Code § 44-10-14. Provided further, these rules shall not be interpreted to limit a circuit court from appointing a guardian for a minor child in an abuse and neglect case brought pursuant to W.Va. § 49-4-601, et seq.
